The number of Shares reported as beneficially owned consists of (i) 3,705,310 Shares, and (ii) Shares issuable upon the exercise of warrants to purchase Shares (the “Warrants”). The Warrants are not exercisable to the extent that the total number of Shares then beneficially owned by a Reporting Person and its affiliates and any other persons whose beneficial ownership of Shares would be aggregated with such Reporting Person for purposes of Section 13(d) of the Exchange Act, would exceed 4.99%.

The Company’s Quarterly Report on Form 10-Q for the quarterly period ended September 30, 2019 indicates there were 206,408,240 Shares outstanding as of October 31, 2019.

Going back to the warrants, CVI has 11,750,000 in warrants, and they (I assume) purchased 4,500,000 million shares at 1.311 on Dev 26th. 

Unexercised warrants are enough to trigger a 13G/A filing.  No reason to believe they are long any shares at the moment.

A stipulation of them getting the warrants was the purchase of 4,500,000 shares by Dec 26th. That appears to have happened. From the above, it looks like they still had 3.7m shares at some date. I'm just not sure how far into the past this disclosure is from. They indeed may not have any shares right now
