United is not the one being sued, it is the contrary. This will not stop the FDA from making a decision in regards to DPI Trepostinil on or before October 15th. Now if it WAS United on the defending side of a lawsuit from Liquidia, that’s another story. Everyone take it easy and relax, in the world of Biotech, leading up to huge FDA decisions and catalysts which can make or break smaller companies, shade and doubt becomes commonplace to attempt a scare for your shares, as does the aggressive manipulation of stock price to scare even further. Hold tight, this is going to be a great outcome for us in about 2 months.

In response, United Therapeutics sued Liquidia for infringing two patents, U.S. Patent Nos. 9,604,901 and 9,593,066, and later added a third patent, U.S. Patent No. 10,716,793, in the United States District Court for the District of Delaware.
That may be what UTHR claims, and maybe what UTHR claims is in fact true, but I'm willing to bet Liquidia will have a different take on things. And who knows what a court will decide.

This is pick and choose snoozy news. UTHR has the upper hand and will likely be first to market. It's still uncertain if Liquidia will be allowed to get there, given there are three patents involved in the suit. We don't help our stock price by over-interpreting the (non)importance of select(ively) negative news items. I posted the development without comment. But anyone with any serious money invested here (which is most of us), needs to be aware of every headline and development that can affect future revenue streams. I’m not overly concerned by this, but i definitely want to bring it into my scan of things to be aware of. I'll grant you that this is a headline, in that it came from Bloomberg, and I'll thank you for sharing and keep it on the periphery of my radar screen. But as for "every could" being a newsworthy item, I base my reactions and most of my investment decisions on collective facts and probabilities. With respect to MNKD, I consider this a fairly to very low probability disruptor - maybe not much more than that, other than the legal costs for UTHR. As for serious money, I consider the equivalent of two full years of post tax salary invested to be pretty serious, and I put a buy in for more shares, today. I'm no MTOI, but I'm all in for real.

Liquidia is hardly a competitive threat either way and they are also facing trade secret theft (a federal crime). Liquidia has: • NO preclinical data • NO long-term studies on their dry powder • NO rapport with PAH physicians • NO supply chain • NO sales force • NO experience selling a PAH product (or any product for that matter) • INFERIOR inhaler • INFERIOR dry powder formulation • INFERIOR clinical trials data • 0% FDA approved products • and so on
