My own impression from reviewing the original prospectus is that the 9 million shares were part of a hedge established for some institution buying the convertible bond. The way it reads, it sounds like, once the bond came due, the convertible holder simply converted the bond, handed those shares over to BoA, who, in turn, returned them to MNKD. Has MNKD confirmed or denied that the shares have already been returned? Not returned YET! - confirmed

We can only hope that the formulary numbers start changing. They haven't budged for many months now, at least not as viewed on formularylookup.com Like you I've been checking formularylookup and thought there been no change. I've been checking the percentages only. But mnholdem may have picked the inflection point mnkd.proboards.com/post/41004. Some could call it noise but it does seem that when you focus on the actual plans (instead of overall percentages) there has been a slight shift in the last couple of days to better coverage.. hopefully the bow wave of something bigger to come. I have snapshots stored going back to beginning of May. I've previously gotten excited about small positive movement only to have the numbers reverse. Hence, I'm still considering movement noise. Even the total number of plans they have in the system goes up AND down. Any given insurance company may have many different formularies, creating new ones and dropping old ones all the time... especially now as over the past few years pre ACA plans have been phased out and replaced. My company is just now losing grandfathered pre ACA in Dec. I'm not getting excited about things until lives covered changes. Let's say there is some insurer that likes Afrezza and has it covered with no restrictions and have 4 fomularies to cover their plans and then make a change splitting things into 5 formularies. The number of formularies with "covered" has just jumped but with no actual improvement in patient coverage with regard to Afrezza.

Why does everyone think that the shares have not been covered yet? Do you think they would wait until the last minute? I actually think the cover occurred June/July. I agree. The price spiked up to a bit over 7 very briefly in June with some pretty high trading volumes. Maybe someone can point to another reason for the spike but I was attributing it to the 9 million shares.

Would have rather all those docs went out and prescribed afrezza rather than buying stock Or, maybe have done both!! lol...who knows, maybe they did all prescribe after the meeting but it isn't showing up for all the reasons that have been mentioned to explain how long it takes to get a script for afrezza on the books.

referencing the post where I predicted 3's or worse, or, the post in that thread where I said SNY are geniuses and this is a great plan they have? Because, I really wish I was wrong about the 3's and I do wish I was right about the "genius" part regarding SNY. Maybe in the near future SNY will in fact prove to be geniuses..........but here in October given our apparent course, its' hard to see the genius in this........

Can be that 9 M. shares have been covered in the period May 15th - May 30th ?
During that period average shares volume was huge and SI increased from 112 Million to 131 Million ..... and PPS increasing from 4$ to 5,16$
Due to high increase of PPS and at the same time of SI seems that "shorters" served a plate of shares to some one who needed to buy a big amount in order to not have PPS skyrocketting.
Don't know if it was the 9 million from BoA (not sure but if I remember well, BlackRock too during that period increased their MNKD portfolio).

I do not believe Bank of America covered in any way before July. According to its form 13-HR (13-F) for Jun 30: - 226,000 shares in its name; - 2.1 M at Merrill Lynch, but as a wealth manager it should be its clients' not BoA's; Anyway, as of June 30, this was far from 9,000,000... www.sec.gov/Archives/edgar/data/70858/000114036115032042/0001140361-15-032042-index.htm
