I choose to believe the management with my yes vote on my suffering shares. And I choose to believe in their judgement on this one also. Think this way: Some clauses in the agreement were terrible and a potential partnersaw it and ask for it in the bargain. Of course MNKD will refute it, still, that weakens MNKD's position, for nothing! I know I have chosen to be blind, and so far it was for worse, but I am more hopeful everyday. I think this is close. But the bargain ended when the partnership ceased No future partner would be entitled to the same benefit of a sweetheart deal that the company probably made in 2014. It should remain confidential.

We got a cash payoff from SNY, and they “repurchased insulin” as a settlement at the end of the partnership. As part of the agreement, there was probably a non-disclosure agreement and the agreement not to sue, simple as that. I don't know, but I would be surprised if the SEC would make an exception due to a non-disclosure agreement. If that was the case, then couldn't shady companies could enter into token NDAs with friendly third parties just to keep information from the eyes of investors? Yet I've never heard of that happening. I may well be wrong. It's now a defunct agreement. Almost by definition that makes it presently immaterial to shareholders. It hardly seems like an exception that the SEC would rubber stamp not releasing it fully at this point. I don't think the FDA considers an NDA in their process of evaluating these requests. They would consider whether there is a valid business reason for secrecy which outweighs shareholders right to know. Since the info is now immaterial, almost any business argument for continued redaction would likely meet the threshold.

Hammer I agree with your last sentence. We were told that they wanted to keep some aspects of the contract with Sanofi secret because they did not want to show their hand. Another words they wanted it kept confidential from other pharma companies so as not to tell their trade secrets. It could be that lawyers for Sanofi are pressuring MNKD to keep it confidential. I,m not sure why MNKD would do anything Sanofi would ask of them at this point but one things for certain it is troubling. I wouldn’t make to much of it it’s probably nothing but trying to keep how they were going to commercialize Afrezza secret. Sorry to ask stupid question, but what is meant by "again"? rwh as of this posting has been awarded their very first post here, not like they have posted this before or something. Athough completely vindictive towards society's unproductive lot, a shining example of pure genius; Al Mann of the early 1900s.

Ayn Rand was a quintessential American, born in Russia. As a child, growing up under the communistic conditions, she saw firsthand the stranglehold that government can impose upon individual achievement. She detested the imposition of collective values on society because she valued reason and knowledge above the mysticism of religion and social convention. Her fathers pharmacy and building were confiscated by Lenin and the Bolshevik revolution when she was 12, helping to form her political views.
In her book, Atlas Shrugged, the most creative and intelligent individuals are convinced by John Gault to withdraw from society, holding back from their best achievements. They start disappearing from the world, leaving the government officials to basically fend for themselves until they fail completely or kill themselves by being so shortsighted. "It's almost as if they want to die." Is one line I remember. Great novel. It has to be top 10 or 20 novels of all time. A lot of parallels to today's ridiculous government happenings. I highly recommend it.
Al Mann would have gotten his invitation to their secret city in the mountains, for sure.

The initial FDA label and the spirometry requirements coupled with the lack of near term insurance coverage left Al Mann in the weakest negotiating position possible. 3 yrs of disaster and shareholder torment could have been avoided with a 2014 shelf offering just after the SNY deal was announced. 50m shares could have funded 3 TS drugs and covered all of the company's expenses to date. There is obviously something in that agreement that prevented MNKD from raising capital in late 2014. Be careful what you wish for. well doctor whatever, sanofi had the euglycemic clamp information MNKD used to change the label and never acted on it. MNKD could not use the information until we got it back.
Sanofi did not work on the label change or insurance.
