I saw it, this Clover is in the same bush league as Looking For Diogenes. All they post are one-sided, garbage hit pieces.

I saw it. Made the rounds on StockTwits. Another short basher. The whole thing is no big deal they didn’t even get a fine, what’s interesting to me is why none of this social media has been put back up...what are we waiting for:-)) ?

Gosh, those short bashers are just everywhere aren't they? It's just amazing to me how the article then does a pivot to trash MNKD even further, totally unrelated to the header. I should've known better than to even click on a SA article. They got me for once. Mahalo for clarifying Sports.

I would think that if the FDA had issued them a letter that was material in nature, they would have had to disclose it with a press release or 8-k. This headline is sensationalistic and meant to be click bait.

This headline is sensationalistic and meant to be click bait. The letter was posted publicly on the FDA site, so it may be that obviates Mannkind having to also announce it. However, you may still be correct about it not being material. But at the same time, it is also true that Mannkind in the past did not release material information by the time it was supposed to have done so (the NSADAQ notice of delisting letter fiasco).

It reads pretty much like a hit piece. Clover does not like MNKD. Plus Clover wants to sell their newsletter - notice the plug in the middle. MNKD is always going to get a lot of clicks, almost certainly more than they would otherwise get.

Almost certainly they have outside council reading each and every post to make sure that there is nothing else lurking out there. I have been bought into similar incidents but with the FTC rather than the FDA (my role was advisory, not legal).

The article was factual, FDA did issue a warning letter and they did quote it properly. However, as warning letters go this was a mild rebuke for ignoring the label copy (an entirely fair point) but this was not a particularly stinging indictment of MNKD. Repeated violations of this type might elicit a stronger response, but as a first offense it is not a huge deal.
The message here is that we you have a black box warning on a drug, the manufacturer cannot make it look like an entirely benign therapeutic, and that is what the social media posting did.
