This also seems to fit with the foreign trade zone or sub zone application. My questions is, why do they file a patent if they are going to sell in China? I realize that question seems obvious but are patents normally filed in countries where you intend to sell a product?

Last year I remember reading that foreign patents are intended to protect a company's drug from being counterfeited within the host country. While I don't really know if it can prevent it from happening, the patent may give MannKind/Sanofi some future (and hopefully unnecessary) leverage in the international courts in the global fight against drug counterfeiters.

I have been doing business in China for over 20 years. My single biggest problem is theft of intellectual property. There is almost no way to stop it completely, but having a Chinese patent is probably one of the only ways of fighting back. MNKD should also file design copyrights for Technosphere. Nothing over there is foolproof, but these steps are a good and necessary start.
