What if he breaks down and tells all? It's happened before, remember the GSCO whisteblower who told all when resigning? (Likewise the retiring SEC official who publicly admitted at his retirement party that the SEC bosses go easy on Wall Street enforcement for fear of damaging future employment prospects?) Martin loves attention. Maybe this is his chance to go from hated, to pitied, product of a corrupt, greedy machine with no real well defined boundaries between parts of the govt and Wall Street. That is unarguably the case with SEC and GSCO but it seems that FDA had at least one corrupt employee at about that time (who made multiple trades based on internal knowledge of FDA decisions). Who knows maybe it goes all the way to the top? We don't know, but Martin might. Here's your chance kid, fess up, save face and you could still have a bright future. Maybe we'll even put you in the Witness Protection Program... new name, new face, new identity.... .............okay getting carried away now.................................... Who wants HIM in witnesss protection? I'd like to see him hang by his ears! People like him never change. Shrek sent the FDA a letter urging them to not approve Afrezza due to trial design and noted in that letter that he was shorting the stock. Therefore I don't think they could sue him unless it could be proven that Shrek had colluded in some fashion with the FDA. Hmmm - or, if they could prove Hamburg's hedge fund husband colluded with Shrek, and that Hamburg's husband influenced his wife, you might have a case. Just blue skying here.

I wouldn't give a flying [...***...] about the lawsuit but rather the PR it would generate during this "high profile" case against the dipshit phrma bro. Think about it, he caused a delay in getting the life saving drug Afrezza which by the way lower HbA1C significantly and offers diabetics another option to fight their disease. Play it up and use the buzz for good.

I am not saying to go into a lengthy court battle but file a summons and complaint against him. Who cares if it gets thrown out. Would be really cheap exposure and drive new investors in a market where a lot of people are sitting on cash. Last time I checked MNKD has nothing to do with putting the drug in peoples hands. Thats SNY. In fact with not much producing of Afrezza happening right now and no techno sphere applications they have all the time in the world. |
