Nice article. It will be a real heard scratcher if no one else's name comes out of his investigation but it wont surprise me either

For those smarter then me. From the article
Regulation SHO states : “Rule 203(b)(1) and (2) — Locate Requirements. Rule 203(b)(1) generally prohibits a broker-dealer from accepting a short sale order in any equity security from another person, or effecting a short sale order in an equity security for the broker-dealer’s own account, unless the broker-dealer has:
borrowed the security
entered into a bona-fide arrangement to borrow the security
has reasonable grounds to believe that the security can be borrowed so that it can be delivered on the date delivery is due
If the transaction occurs without the shares being available and they cannot be delivered would this cause a failure to deliver which is a naked short? Am I understanding this right?

MNKD stock fell on heavy volume around that Feb 1st 2011 timeframe, hmmm, right after CRL news that he lobbied for Dec 25th 2010. Stinks a lot!

I think it goes something like this: Brokerage Firm to Hedge Fund: Hey you seem like honest guys, here's direct access to our trading system and naked shorting privileges (ostensibly to maintain orderly markets as a Market Maker). Feel free to use it in pursuit of your trading strategy. And by the way, thanks for the order flow!

I believe that they can still indict him on additional charges that may or may not include MNKD. While reading that article, I found what I was reading was more than eerily familiar to what we have witnessed while owning MNKD for the last six years. This IS a Golden Opportunity for the SEC/FBI. If more indictments are not issued, it will prove to be a case of the fox guarding the chicken coop, and that the corruption runs VERY deep! I hate to believe that there could be such a huge conspiracy, but I believe that members of the SEC had to be aware of it! Jim Cramer and Adam Feurstein should be sweating right now because they are probably next! Not to mention Goldman Sachs!
