I have liked this thread very much. I've learned a lot. I am curious to read @ryster response to the question. Why should the thread go away? Hitting too close to home? Worried this anti-NS sentiment might continue to grow.
I don’t know the reason, but I doubt that is it. Yeah, shouldn’t speculate but couldn’t help myself since it was such an odd “out of left field” comment. Ryster can speak for themselves, and has been invited to, but seems to have gone silent. Thank you Harryx1 for drawing attention to the topic. I’ve become numb to the corruption I’ve assumed existed for some years now, but I would very much like to see change, so I like it that there is increased scrutiny and activism.

Well, it's a start but (T-0) would be better... SEC Finalizes Rules to Reduce Risks in Clearance and Settlement Final rules will shorten process for settling securities transactions from two business days to one www.sec.gov/news/press-release/2023-29From Press Release so still 1 year 3 months away. The adopting release is published on SEC.gov and will be published in the Federal Register. The final rules will become effective 60 days after publication in the Federal Register. The compliance date for the final rules is May 28, 2024. The SEC can reduce not to 1 day but to negative 10 days if they don't enforce it, and so far there are no indications they enforce anything related to failure to deliver. Same with guns, they pass hundreds of stupid laws and nothing is enforced. Immigration, same thing.

ShareIntel is only one of the companies involved. There are three typically engaged. ShareIntel is the company which mines publicly available trading information to look for markers of abusive naked short selling. Buyins.net is the company which works with law firms to provide assistance with discovery and analysis of private "blue sheet" trading information to identify and confirm illegal naked shorting. Law firms which hire Buyins.net (and possibly ShareIntel as well) for expert witness testimony are the 3rd.
I hope that some of the money that ShareIntel and Buyins.net earn will be coming from MannKind if there is reason to be confident it is money well spent. There really isn't any reason to spend much money or time on investigating illegal naked shorting of MNKD unless there is a reasonable expectation that money can be recovered based on the harm that was caused.
I don't know if there is a statute of limitation when it comes to illegal naked shorting. If there is not a statute of limitation, than the massive naked shorting of 2015 would be relevant as a source of evidence for a lawsuit against the perpetrators. Based on FINRA records, we know naked shorting has occurred to MNKD since 2015 and indeed as recently as 2022. So it seems reasonable to ask how much does ShareIntel want to be paid to look for markers? And are they willing to do the work for free as part of an agreement to be compensated if a lawsuit is successful in recovering money for harm (and punitive damages?)?
If ShareIntel is confident they can hit pay dirt investigating MNKD illegal naked shorting, maybe they would be willing to front the work, and similarly, if plaintiff-seeking attorneys can be confident of recovering enough money to make it worth their effort, maybe an investigation and civil suit can progress without a single dollar spent up front by MannKind. I would be OK with MannKind taking a smaller cut of a settlement in return for compensating ShareIntel and Buyins.net.

I have no idea what the timeline is on those investigations but IMO it shows you that there is a problem if more and more companies are investigating the issue. If the offending entities would offer the info to the public that shows everything balances out in a timely manner, there would be no need for ShareIntel but they don't and they hide as much info as they can. Why? Are they afraid of getting caught? Or is it they won't be able to make (steal) their easy billions $$$?

Yes I’m dismissive of us (MNKD) hiring ShareIntel to pursue the naked shorting angle. I prefer we make prudent decisions on spending money, we don’t have an unlimited amount. Extremely poor odds on a good return on any money given to ShareIntel.
You suggest that ShareIntel might operate on a pure contingent fee arrangement. I doubt they will operate like that. If they do, then the equation is better because we’d spend no upfront $$ directly to them. However, it would still be a distraction and require resources in the information gathering (discovery) phase. No thanks. Rather, instead of chasing leprechauns let’s focus on what we are supposed to be doing: negotiating pipeline deals, producing and selling product.
Not sure what the SOL is on these situations, but pretty sure 2015 is outside the time limit. Would be curious about that SOL if anyone knows. Since that time frame, there’s hasn’t been enough naked shorting of MNKD to yield enough potential damages to justify a litigation sinkhole.

I might be persuaded if you could produce examples and information illustrating litigation against illegal naked shorting, such as was brought by Overstock.com, generally failed more often than not to provide useful results. But don't use that example, because in that case Overstock.com prevailed. And, as I said, just as there are lawsuits for injuries which are no-cost to the plaintiff, there can potentially be no upfront cost for MNKD and MNKD shareholders to be parties to a lawsuit (or lawsuits). And a phone call to, and consult with, ShareIntel would almost certainly be free. Nothing ventured, nothing gained.

The phone call is definitely free, no harm in pursuing it that far. But this ain't an Overstock situation. My words aren't designed to "dissuade and prejudice" they are simply my opinions, just as you have yours. There's not always a nefarious conspiracy afoot. But then again, you are entitled to that opinion too!

Besides, from my 50+ years of experience, lawyers confuse the situation, drag it out and only truly care about getting more billable hours. Save the expense whenever possible. JMHO
